This is an agreement between the bonchat.org site owners and operators ("Bonchat") and customers and users ("you" or "your") of the Bonchat website and service ("the service"). It governs your use of the service, and by using the service, you agree to comply with it.
This agreement was last updated on September 5th, 2010. Bonchat may change it from time to time without prior notice. You can find it at http://bonchat.org/terms .
You will abide by all applicable laws. You will not use or abuse the service in any way which:
infringes on the copyright, trademark, patent, trade secret, or other intellectual property rights of any party;
is harmful, deceptive, tortious, libelous, inflammatory, unauthorized, excessively heavy, a violation of privacy, or otherwise objectionable; and/or
impedes or interferes with others' use of the service.
Bonchat has the right, but not the obligation, to enforce these terms by means including:
making any of your public data private;
limiting your use of the service via bandwidth caps; and/or
cancelling your account.
Your use of the service is at your sole risk. The service is provided "as is", "with all faults", and "as available". Bonchat is not liable for any kind of damages arising from any matter relating to the service.
Bonchat does not warrant that the service will be secure, available, accurate, reliable, or fast. Bonchat does not warrant that the service will meet your requirements or expectations.
The service makes periodic backups of your data, but recommends that you do so as well for greater reliability. The service does not replace a local backup.
If Bonchat becomes aware of a problem causing a significant security breach or loss of your data, it will immediately begin effort to mitigate and end it. Within 24 hours or as soon as possible, Bonchat will notify you of the approximate nature and scope of such an event affecting your data, either directly or in a central place such as a news blog.
Bonchat may change any price with 30 days' notice. Bonchat will not increase your charge per billing cycle without your consent.
The service is billed in advance. You are responsible for any obligations beyond the billed amount, including taxes and your internet connection or bandwidth fees.
When purchased as a monthly subscription, the service is billed in advance in cycles of approximately 30 days. Your first billing cycle starts the day you sign up for billable service and runs to that day-of-the-month in the next calendar month, or to the end of the next month if it has fewer days. Following cycles start as close as possible to the day-of-the-month on which your first cycle did.
You or Bonchat can cancel your account at any time without prior notice and for any reason. Cancellation leads to the deletion of the account, including all its data and abilities regarding the service.
Specifically, Bonchat may cancel your account after a period of inactivity, such as 6 months.
When an account is cancelled:
if Bonchat cancels it, it will be deleted immediately with all its data, and the remainder of its billing cycle will be refunded (pro rata), but, if reasonably practicable, its data will be sent within 30 days to its administrator's contact e-mail address in a form of Bonchat's choosing (such as compressed plain text); or,
if you cancel it, it will be deleted with all its data at the end of its billing cycle, until which time it will be fully usable.
